• Machine learning inference capabilities

• Custom model training and fine-tuning 

• Developer tools and integrations 

3. Eligibility 

For All Users 

• Must be authorized to enter binding agreements 

• Must provide accurate and complete information 

• Must comply with all applicable laws 

For Enterprise Users 

• Must provide verification of business status 

• Must comply with all applicable business regulations 

4. AI Service Terms 

No Guarantee of Accuracy AI-generated content is experimental technology that may produce inaccurate, incomplete, or inappropriate outputs. You are solely responsible for evaluating all outputs before use. 

No High-Stakes Decision Making Our services are not designed for high-stakes automated decisions affecting individual safety, rights, or well-being without appropriate human oversight. 

Model Versions 

• We may update models to improve performance and safety 

• Deprecated models remain available for 30 days after notice 

• API changes require 30 days advance notice 

5. Data and Privacy 

Your Data Ownership You retain all ownership rights in data you provide. You own all AI-generated outputs, though outputs may not be unique across users. 

Data Usage for Service Improvement 

• Free accounts: We may use your data to improve our services (you can opt-out) 

• Business accounts: We will not use your data without explicit permission 

• Enterprise accounts: Zero data retention options available 

Data Retention 

• Operational data: 30 days maximum 

• Training data: Only with your permission 

• Account data: Until account deletion 

6. Prohibited Uses 

You may not use our services for: 

• Illegal activities or harmful content 

• Harassment, hate speech, or violence 

• Deceiving others about AI-generated content 

• Unauthorized surveillance or biometric identification 

• Circumventing our safety measures 

• Violating third-party rights 

• High-risk applications without human oversight 

7. API and Usage Limits 

Rate Limits Usage limits apply based on your subscription tier. Exceeding limits may result in temporary service restrictions. 

Service Availability 

• Free accounts: No uptime guarantee 

• Business accounts: 99.5% uptime target 

• Enterprise accounts: Custom SLA available 

8. Intellectual Property 

Your Content You retain ownership of all input content and generated outputs. We do not claim rights to your creations. 

Our Services Our AI models, algorithms, and platform technology remain our proprietary property. 

Third-Party Content Some features may incorporate third-party AI services with separate terms. 

9. Payment and Billing 

Subscription Fees Fees are charged in advance and are non-refundable except as required by law. 

Usage-Based Billing API usage charges apply based on your subscription plan and actual usage. 

Price Changes We may modify pricing with 30 days notice to existing customers. 

10. Content Moderation 

We employ automated systems to detect and prevent prohibited content. Appeals can be submitted through our support system. 

11. Export Controls 

You represent that you and your end users are not located in embargoed territories or on restricted party lists. Our services may not be used in violation of export control laws. 

12. Disclaimers 

AS IS SERVICE Our services are provided "AS IS" without warranties of any kind. We make no guarantees about: 

• Service availability or performance 

• Accuracy of AI-generated content 

• Fitness for any particular purpose 

Emerging Technology AI services use emerging technology with inherent limitations and risks. 

13. Limitation of Liability 

Liability Cap Our total liability is limited to the greater of $500 or amounts paid by you in the preceding 12 months. 

Excluded Damages We are not liable for indirect, consequential, punitive, or special damages. 

Your Responsibility You are solely responsible for your use of AI outputs and compliance with applicable laws. 

14. Indemnification 

You agree to indemnify us against claims arising from: 

• Your breach of these terms 

• Your violation of laws or third-party rights 

• Your use of our services or AI outputs 

15. Termination 

By You You may terminate your account at any time. 

By Us We may suspend or terminate accounts for: 

• Terms of service violations 

• Prohibited use of our services 

• Non-payment of fees 

16. Dispute Resolution 

Informal Resolution Contact us first for informal resolution (45 days required). 

Arbitration Disputes resolved through binding arbitration under JAMS rules in Delaware. 

Class Action Waiver No class action or representative proceedings permitted. 

17. General Terms 

Governing Law Delaware law governs these terms. 

Modifications We may update these terms with 30 days notice. 

Severability If any provision is unenforceable, remaining provisions remain in effect.
